HireCinch (hereinafter referred to as “HireCinch”, “us”, “our”, “we”, or “Company”) aims to provide an online all-in-one recruiting system to streamline the hiring process (the “Services”). These Services are owned, operated, and made available to you by Carte Blanche Innovation Integrated LLC, a limited liability company incorporated under the laws of Illinois, bearing company number 009361898, with its registered office at 1821 W., Thornwood Lane, Mount Prospect, IL, 60056, (the “Carte Blanche”). Carte Blanche is a product-based company which builds cloud-based solutions for its global clientele. This Privacy Policy (the “Policy”) intends to help you comprehend the information we collect from our users visiting or using our website or application (hereinafter referred to as “user”, “recruiter”, “candidate”, “you”, “your”, or “yours”), and through other interactions and communications you have with us.

This Policy sets out the basis of how we use the information collected, and when we use it, to provide our Services. This Policy describes our privacy practices concerning information and personal data collected in connection with the Services. You are requested to carefully read this Policy before accessing or using our Services. If you do not agree with any part of this Policy, you are suggested to not use or access our Services.

We reserve the right to change, modify, add, or remove portions of this Policy at any time without any prior notification. Any such changes shall be effective as soon as we post such amendment or modification on or through our website, web application, communicate the same to you through email notification, or any similar means. Please check this Policy regularly for updates and amendments. Any continued performance or use of the Services shall be deemed your consent to such revised Policy.

Scope and application

This Policy applies to all the users and visitors of our website or the web-application anywhere in world who may access or use our Services as well as to any other persons who may use the Services. This Policy further applies to all transactions, activities, and data gathered through the use of Services.

Data Collection

In order to operate HireCinch and to provide you with information about our Services that may be of your interest, we may use your personal information. When you use our Services, we may collect personal information (i.e., information specifically utilized to contact you directly including, but not limited to, full name, company name, email address etc.) (“Personal Information”) and demographic information (i.e., information which is not Personal Information; including, but not limited to, username, device information, browsing history information, device location, and IP address) (“Demographic Information”). Demographic Information is further categorized into two types: private information including, but not limited to, transaction information and communications or interactions with customer support of HireCinch; and public information, that includes other demographic information. Personal Information along with Demographic Information is referred as “Personal Data” herein.

A. Data Provided by Users:

1. Web Application Sign-Up

We may collect Personal Data including, but not limited to full name, email address, company name etc. at the time a user registers with us through our web application. The user may also be required to provide its company phone number, personal phone number, job title, time zone info, company website, company logo, etc. after the registration in addition to payment or banking information, if so required.

2. Background Check and Identity Verification

Background verification is done for all users using OTP via phone number through a third-party or through other forms of verification as deemed fit by HireCinch from time to time. We may also share your email address with a third party for such verification purposes. You hereby represent and warrant that you have the authority to provide us with any such contact information.

‍3. User Content

We may collect the information that users submit while interacting and communicating with our customer support. This may also include any feedback or suggestions that the user provides. We may collect the information that the recruiter posts with regards to a job posting using the Services. We also collect all Personal Information requested from candidate by the recruiter at the time of applying for the job including, but not limited to, full name, email, phone number, location, resume, academic history, professional experience, profile links etc. We only collect this information acting in our capacity as a data processor while acting solely on behalf of the recruiter who shall be the data controller.

B. Data Collected During Use of Services:

1. Website/Landing Page

When you browse our website/landing page (https://www.hirecinch.com/), we may collect the Internet Protocol (IP) address of the device you are using and cookies (small files that we embed on your computer, only if you consent to it) to enable our system to recognize your browser and capture and retain certain information. We collect this data so that we can identify why our visitors are dropping out of the website and to identify areas of improvement to make the experience more engaging for you. You hereby represent and warrant that you comprehend and agree that all information collected by HireCinch are utilized to enhance the security of our user and Services.

When filling any form including, without limitation, the contact us form, at the completion of entering your contact information, your IP address is no longer anonymous, and we shall be able to identify you by combination of your IP address and contact information.

2. Location Data

We may collect precise location data from user’s device using third party services when you use our website or our Services. We use this data to locate our users and to assist us in providing targeting advertisement to our users making the user-experience better.

3. Transaction Data

We may collect transaction information with regards to your use of our Services including, but not limited to, Services requested by the user and provided by the user, delivery information, date, and time the service was provided, payment details, and payment method selected.

4. Usage Data

We may collect information regarding how users interacted with our Services including, but not limited to, date and time of access, app crash report, and app features used. We may also collect data through use or capture of cookies. We may also collect communication between the recruiter and candidate including, but not limited to, messages, email address, and attachments etc. We may also collect data through use or capture of cookies.

5. Updates

We may collect your email addresses to customize your record and send you solicitations or updates related to our application; this is not a mandatory requirement; it is completely upon your discretion if you want to receive this information.

6. Third Parties

We may collect your information for third parties including, but not limited to, OTP/email or OTP/phone-number verification services providers, insurance partners, money-related specialists etc.

How we may use your personal data

We may use Personal Data which you provide to us, or we collect from you including, but not limited to:

  1. Improve our Services to ensure user satisfaction.  
  1. To respond to feedbacks, concerns, questions, disputes, issues, or to any information requested by the users.
  1. Maintain and provide new features and improve customer support for users.
  1. Develop and ensure safety features to help monitor, prevent, and detect fraud, enhance security, monitor and combat spam or other malware security risks.  
  1. Send communication based on your interest, for instance, promotions, news, and updates. All such marketing activity shall be conducted under the purview of applicable law.
  1. Make the payment facilitation process more efficient for you.  
  1. For provision of our Services to you, whether or not, through our web application, platform, or website, as the case may be.

How HireCinch shares your personal data

We may share your Personal Data which you provide to us or we collect from you to:

  1. We may share the Personal Data that we collect from the candidate that may include, but not limited to, full name, contact details, resume, professional experience, academic experience or location with the recruiter for the job that you applied for.
  1. We may only share your information with the third parties whose services we are taking in regards to the purpose to pursue our business such as our payment service providers. We may share your Personal Data with third parties when necessary for the payment facilitation process. We share this data with our payment facilitation provider, Stripe, who ensures secure, safe, and efficient transactions.
  1. We may share your Personal Data with other third parties when necessary to fulfill your requests for Services. However, third parties must comply with their privacy policy regarding the protection and privacy of the shared Personal Data of our users.
  1. We may likewise utilize or share your Personal Data with third parties when we have reason to believe that doing so is necessary to comply with applicable law or a court order, subpoena, or other legal process; to investigate, prevent, or take action regarding illegal suspected fraud; violations of our terms and conditions; or situations involving threats to our users and/or users.
  1. However, we shall never sell or rent your Personal Data to any third-party.

Our legal basis for processing your personal data

Our legal basis for collecting or processing your Personal Data is dependent on the specific context in which we collect it. We may collect or process your Personal Data for any of the following reasons, without limitation:

We may use your Personal Data in lieu of performing the contract with you and to provide you with the Services. We use your Personal Data to fulfil our obligations under the contract.

2. Legitimate Interest

We may use your Personal Data for our legitimate interest, for instance, to provide you, our Services. The right to legitimate interest is not overridden by your rights.

We may use your Personal Data by taking your consent to use your Personal Data. This includes, without limitation, direct marketing purposes, newsletter, and promotional services.

International data transfer

Your interaction with HireCinch either as a recruiter or candidate may involve transferring of your Personal Data for processing and maintaining of servers or databases located in countries other than the jurisdiction where you are located. Such countries and jurisdictions may have data protection laws that provides a level of protection which may, in some cases, be less protective of your Personal Data than the jurisdiction you live. By using our website and our Services, you give us consent to transfer your data to such countries.  

We have facilities and staff in different countries around the world and as a result, Personal Data may be transferred to them or accessed from those locations. We take all the necessary actions to ensure the security of your personal information when transferred across borders and have in place appropriate technical safeguards for safety of same.  

Where applicable law requires HireCinch to ensure that an international data transfer is governed by a data transfer mechanism, HireCinch will use an appropriate lawful transfer mechanism. Transfers within the Carte Blanche group will be covered by an internal processing agreement entered into by the members of the Carte Blanche group (an intra-group agreement) and standard contractual clauses which contractually oblige each member to ensure that Personal Data receives an adequate and consistent level of protection wherever it is transferred to.

Your rights under General Data Protection Regulation(GDPR)

You may have the following rights to data protection rights under GDPR:  

  1. You have the right to access, update or to delete the information we have on you. You have the right to demand information with regards to purpose of processing, categories of Personal Data, data retention period etc., as per Article 15 of GDPR;  
  2. You have the right to obtain rectification of any inaccurate or incomplete information as per Article 16 of GDPR;
  3. You have the right to obtain erasure of your Personal Data that we have stored on you as per Article 17 of GDPR;
  4. You have the right to request restriction on processing of your Personal Data as per Article 18 of GDPR;
  5. You have the right to demand to receive your Personal Data in a structured, machine-readable and commonly used format as per Article 20;
  6. You have the right to object to the processing of your Personal Data as per Article 21 of GDPR;
  7. You have the right to withdraw consent any time where Whistle it relied on your consent to process your Personal Data as per Article 7(3) of GDPR.

Your rights under California Privacy Law

A business which is subject to California Civil Code Section 1798.83, the users who are California residents may make a request of certain information regarding our disclosure of your Personal Data to third parties for their marketing purposes. This section further lays out details regarding Personal Data that we collect about California users and the rights provided to them under CCPA. If you are a resident of California and have shared Personal Data with us. You may have, subject to certain limitation, additional rights under CCPA to users residing in California. You may have the right to:

  1. Request more details regarding the categories of Personal Data we collect; and
  2. Request to delete your Personal Data.

Retention of Personal Data

HireCinch retains your Personal Data in accordance with the recruiter instructions or for as long as we need to provide the Services to the recruiter. We may delete your Personal Data upon on your request. We may retain your Personal Data until your account is active or if required by us to fulfil our obligations to provide our Services or comply with the applicable laws or regulations. We may automatically delete your Personal Data upon fulfillment of our obligations. We may either delete or anonymize your data if we have no legal justifiable reasons to retain your Personal Data.

1. Website Visitors

We may retain your information if you have opted to receive our marketing emails indefinitely until you unsubscribe. Once you unsubscribe from marketing communications, we ensure that you will receive no marketing emails from us of any sort. Furthermore, we may also retain information acquired from cookies as given below for a reasonable period of time from the date such information was first created.

2. Recruiters and Candidates

We may retain your Personal Data if you have acquired our Services. Recruiters may delete on their own any data that they share on the platform, including, but not limited to, job posting, candidate’s data etc. Furthermore, the recruiters may have the option to customize the retention settings as it may deem fit.  

In addition to the retention periods mentioned above, in some circumstances we may store your Personal Data for longer periods of time, for example (i) where we are required to do so in accordance with legal, regulatory, tax or accounting requirements, or (ii) for us to have an accurate record of your dealings with us in the event of any complaints or challenges, or (iii) if we reasonably believe there is a prospect of litigation relating to your personal data or dealings.

Storage and Security

We use all reasonable endeavors to maintain the security of your Personal Data and to protect the same from misuse, intervention, loss due to unauthorized access, modifications, or disclosures. All the data is stored in our designated servers. We delete all the data once it is no longer required under the terms of this Policy. We may retain your Personal Data to comply with our legal obligations or resolve disputes. HireCinch pursuant to the limits imposed by the applicable law, will try to delete your Personal Data within the justifiable limit.

Your HireCinch account is password-protected so that only you and authorised HireCinch’s employees have access to your account information. HireCinch’s staff will never proactively reach out to you and ask for any information related to your account access including your password.

HireCinch takes pride in ensuring that your Personal Data is kept safe and secure. HireCinch has dedicated staff for respecting and implementing this Policy. However, no data transmission over the internet can ever be 100% protected. Therefore, we do not guarantee the security of any Personal Data you provide to us. Please note that we cannot guarantee that the information will not be compromised as a result of unauthorized penetration to our servers. As the security of information depends in part on the security of the computer, device or network you use to communicate with us and the security you use to protect your user IDs and passwords, please make sure to take appropriate measures to protect this information. You hereby represent and warrant that you understand that you share your Personal Data at your own risk. To the extent permitted by the law, HireCinch expressly disclaims any liability that may arise in an event if any unauthorised individual or third party obtains or gets access to the Personal Data you submit to us.

Corrections and updates to your personal information

You may correct your factual errors in your Personal Information by using the HireCinch’s web-application/platform and editing your information by selecting the “Settings” option and making the desired changes.

E-mail subscriptions or opting out

You may opt out of receiving promotional and latest announcements of software updates and Services by simply unsubscribing. If you may like to stop receiving emails from us, please send us an email requesting in detail to unsubscribe any specific (or all) email subscriptions.

Billing

  1. Financial transactions relating to our Services are made through basic mode of payments via credit/debit card transaction. You may have the right to choose the payment method.
  1. You can initiate the payment of Services through our platform. To fulfill the purposes stated, we may need to share your Personal Information with our payment service provider, Stripe, or any of our payment or banking partners.

Deletion of account

For any reason whatsoever, in case your HireCinch Account is deactivated or blocked, your Personal Information shall remain available in our database. In case you want us to delete the same or you intend to regain access of your HireCinch Account, you may contact us through our customer support page and submit a request. Please note that currently we don’t allow the user to delete its account, for account deletion please contact us at info@hirecinch.com  

We may retain a bare minimum of your Personal Data to carry out a data analysis or data mapping to prevent you from making another account. Moreover, we may need the same to prevent duplicate accounts being made by any user(s).

Changes to our Privacy Policy

We may update and amend this Policy anytime without any prior notice. In case of any significant changes related to how we treat your Personal Data or to the protection or security strategy, we may give you a notice through the notification section of the web application or through email. Your continued use after such notification will establish your consent and agreement to the most recent terms of this Policy.

Children's privacy

Our Services, related to the user, are directed towards adults of and above eighteen (18) years and we do not intend to provide Services to users below this age. We do not intend to collect, store, process, or maintain personal information from persons under the age of 18, as we presume that all users represent to us that they are at least 18 years old. If you are under the age of eighteen (18), do not provide any Personal Data to us without involvement of a parent or a guardian. For the purposes of the GDPR, we do not intend to offer information society services directly to children. In the event that we become aware that you provide Personal Data in violation of applicable privacy laws, we reserve the right to delete it. From time to time, we may record anonymized and aggregated data about our users, users, and/or users, for example, by distributing a report on patterns in the utilization of our Services. We intend and strive to keep this procedure anonymous and limited to selected few of HireCinch’s staff.

We shall not be liable for any direct, indirect, incidental, special, exemplary, punitive, or consequential damages, including, but not limited to, lost profits, lost data, theft, fraud, personal injury, or property damage related to, in connection with, or otherwise resulting from any acts or omissions in connection with this Policy. However, we take all the complaints seriously and assure you that we shall do our best to accommodate your concern and give a satisfactory outcome.

We may use third party cookies including, but not limited to, Google Analytics, and Mix Panel for the purpose of making user-experience better. We may also use pixel tags (usually in combination with cookies) from third parties to get information about your usage of our website and Services, and your interaction with us through email or other means of communications. We do not use cookies to identify you personally but only to gain useful knowledge about how our website and Services are used so we can keep improving it for our users.
